Jury awards Huntsman $94 million in lawsuit against Praxair/Linde

Huntsman Corporation announced today that a jury in New Orleans has awarded Huntsman a verdict in its long court battle with Praxair/Linde, one of the industrial gas suppliers at Huntsman’s Geismar, Louisiana MDI production site. Smile was awarded $93,878,108. The case came after Praxair refused to properly maintain its own Geismar facility and then repeatedly failed to supply Huntsman with the industrial gas it needed to produce MDI under a long-term supply contract that expired in 2013. The 12-member jury ruled on April 29 that Huntsman will be awarded a total of more than $125 million in damages after the court added a corresponding amount of interest.

Huntsman Chairman, President and CEO Peter R. Huntsman commented on the case after the jury verdict: "This lawsuit was brought in 2014 and the trial has been a very long process. I stand for the entire The Huntsman team is proud - from our Polyurethanes department and purchasing staff, who managed Praxair/Linde's poorly maintained facilities and ongoing operational and commercial issues that occurred from 2004 to 2013; to our corporate legal and The finance team, who persevered after we filed the lawsuit. They demonstrated integrity, professionalism, perseverance and ingenuity - hallmarks of Huntsman employees worldwide - on the field in Geismar and in court in New Orleans Defeating irresponsible and well-funded opponents. I want to honor all of them and thank the 12 members of the jury and the trial judge for their time and commitment to fairness in court.

Peter R. Huntsman continued: "After winning a more than $600 million lawsuit against Albemarle last October, this jury verdict - which we believe will be affirmed on appeal - is the latest in Huntsman's last seven Second major damages award in mid-month. Our General Counsel, David Stryker, led both efforts and assembled an incredible team of internal and external lawyers to ensure that any legal disputes against the company are can be resolved. My management team and I are more than happy to testify in both cases, and I will be happy to testify whenever necessary in the future to ensure our shareholders receive the full value of their holdings.”

The case against Praxair was originally filed in 2014, but did not go to trial until April this year due to reasons including Covid-19. After a three-week trial, the 12-member jury reached a verdict in less than three hours, unanimously finding that Praxair had repeatedly violated its commitments to Huntsman, violations that directly cost Huntsman enormous economic losses. Huntsman was represented in this case by the law firm of Vinson & Elkins and the New Orleans-based trial firm of Chehardy, Sherman & Williams. James M. Williams of Chehardy and Jim Thompson of V&E served as co-lead counsel at the trial.
